It is not uncommon to be sued. Sadly, many people use the legal system to threaten or fight to get something that they want or think they deserve. In some cases these lawsuits are merited and in other cases there are frivolous. Regardless of the validity of the case, it is important that you make sure that you are doing everything that you can to protect yourself. Here are a couple things that you should do if you are being sued.
1. Don't Move Assets Around
Once the lawsuit starts, you cannot start moving assets around. For instance, if you up to this point your home is in your name, it might be considered at risk during the lawsuit. If you lose the suit, you might lose the house to help pay for damages. This is why many people are tempted to go to a lawyer and get their assets protected, like putting the house in their spouse's name, creating LLCs, or moving around money. Unfortunately, once that lawsuit has started, you cannot do this. If you do, you may be in trouble with the law.
This is why it is best to be preemptive in your protection of your estate. Instead of waiting until you get sued to start making changes to your estate, meet with a lawyer right away and ask them what you can do to protect your property. They might tell you to put everything in LLC's, separate your personal and business accounts and so much more.
2. Hire A Lawyer
Even if you think that the other party has no chance in the lawsuit, you should never try to represent yourself in court. There are too many rules and regulations that you don't understand. Making one simple mistake in the courtroom could mean the difference between losing and winning the case. Hiring a lawyer is not about protecting you only if you are in the wrong; it is about protecting you in any circumstance.
The amount of money that you will spend on legal services will be nothing compared to what you have to pay if the lawsuit is not found in your favor. This is why it is better to hire a lawyer and do everything that you can to protect yourself. Your lawyer will be your biggest advocate during this stressful time.
